These Terms and Conditions govern your use of the truEPC website and the commercial Energy Performance Certificate services we provide. By using our website or booking our services, you agree to these terms.
1. Definitions
- "We", "Us", "Our" refers to truEPC
- "You", "Your" refers to the customer or website user
- "Services" refers to Commercial EPC assessments and related services
- "EPC" refers to Energy Performance Certificate
- "NDEA" refers to Non-Domestic Energy Assessor
- "Property" refers to the commercial building being assessed
2. Service Description
We provide Commercial Energy Performance Certificate (EPC) assessments for non-domestic properties in England and Wales. Our services include:
- On-site energy assessment by an accredited NDEA
- Energy modelling using government-approved SBEM software
- Lodging of the EPC certificate on the official government register
- Provision of the EPC certificate and recommendations report
3. Booking and Payment
3.1 Online Quotes
Quotes provided through our online system are estimates based on the information you provide. The final price may be adjusted if:
- The property details provided are inaccurate or incomplete
- The property requires a complex assessment or Level 4 survey not identified during booking
- Access to the property is restricted or additional visits are required
3.2 Payment Terms
Payment options:
- 50% Deposit: Pay half upfront, with the balance due before certificate upload
- 100% Payment: Pay the full amount at the time of booking
All payments are processed securely through Stripe. We accept major credit and debit cards.
3.3 Price Adjustments
If the information provided during booking is found to be incorrect, we reserve the right to issue an adjusted invoice before uploading the EPC certificate. You will be notified of any price changes before work is completed.
4. Site Access and Survey
4.1 Your Responsibilities
You agree to:
- Provide accurate information about the property
- Ensure our assessor has safe and complete access to all areas of the building
- Provide access to heating/cooling systems, plant rooms, and other building services
- Inform us of any hazards, asbestos, or restricted areas before the site visit
- Be present or arrange for a representative to be available during the survey
4.2 Rescheduling and Cancellations
If you need to reschedule:
- More than 48 hours' notice: Free rescheduling
- Less than 48 hours' notice: £50 rescheduling fee
- No access provided on survey date: Full charge applies, new booking required
5. Cancellations and Refunds
5.1 Cancellation by You
- Before site visit arranged: Full refund of deposit
- After site visit arranged but before survey: 50% refund of deposit (if more than 48 hours' notice)
- Less than 48 hours before survey: No refund
- After survey conducted: No refund
5.2 Cancellation by Us
We reserve the right to cancel if:
- Information provided is fraudulent or misleading
- Safe access to the property cannot be provided
- The property requires specialist assessment beyond our capabilities
In such cases, you will receive a full refund within 7 working days.
6. Delivery of Services
6.1 Turnaround Times
Standard turnaround is 1–3 working days from the date of site survey. Turnaround times are estimates and not guarantees unless a fast-track service is explicitly purchased.
6.2 Certificate Delivery
EPC certificates and recommendations reports are delivered by email to the address provided during booking. It is your responsibility to ensure the email address is correct and to check spam/junk folders.
6.3 EPC Register
All certificates are lodged on the official UK EPC Register as required by law.
7. Accuracy of Information
The EPC rating is based on the information collected during the site survey and the assessor's professional judgement. While we strive for accuracy:
- EPCs are assessments, not guarantees of actual energy performance
- Ratings may vary if property conditions change or if full access was not provided
- We are not liable for decisions made based on the EPC rating
8. Limitation of Liability
To the fullest extent permitted by law:
- Our liability is limited to the amount paid for the service
- We are not liable for indirect, consequential, or special damages
- We are not liable for delays caused by factors outside our reasonable control
- We are not liable for losses arising from inaccurate information you provide
Nothing in these terms excludes or limits our liability for death, personal injury, fraud, or any other liability that cannot be excluded by law.
9. Intellectual Property
All content on this website, including text, graphics, logos, and software, is the property of truEPC or our licensors and is protected by copyright and other intellectual property laws.
You may not reproduce, distribute, or create derivative works from our website content without prior written permission.
10. Website Use
You agree not to:
- Use our website for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Transmit viruses or malicious code
- Collect or harvest data from our website using automated means
- Impersonate another person or entity
11. Disputes and Governing Law
These Terms and Conditions are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
Before pursuing legal action, we encourage you to contact us to resolve any issues informally.
12. Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
